Terms of Use

Last updated: August 13, 2026

These Terms of Use govern access to and use of the website operated by Health Builders PC, doing business publicly as Health Builders. The website includes its pages, articles, forms, downloads, graphics, photographs, illustrations, videos, embedded content, software features, and other materials.

Health Builders PC is located at 7540-H Little River Turnpike, Annandale, VA 22003. Questions about these Terms may be directed to 703-256-2600 or info@nvhb.org.

1. Acceptance of These Terms

By accessing or using the website, you agree to these Terms of Use, the Website Privacy Policy, and the Medical Disclaimer. If you do not agree, do not use the website.

A separate acknowledgment presented with a form or electronic transaction also applies to that submission. Health Builders PC may require affirmative acceptance for particular features.

These Terms apply to website access and website-related communications. The Health Builders PC Notice of Privacy Practices governs protected health information and is not limited by these Terms. These Terms do not govern the professional standard of care, informed consent, clinical treatment, medical negligence, malpractice, or another dispute arising from actual healthcare furnished by a healthcare professional. Clinical relationships are governed by applicable law and by the clinical, consent, financial, privacy, and other agreements that apply to the care.

2. Website Purpose

The website provides general information about Health Builders PC, its providers, healthcare services, treatment options, health conditions, educational resources, appointments, forms, prices, insurance, Medicare, location, and policies.

Website content is educational and informational. It does not provide individualized medical advice, diagnosis, prescription, or treatment recommendations. The Medical Disclaimer is incorporated into these Terms.

3. Emergencies

Do not use the website, a website form, or ordinary email for an emergency. Call 911 or seek emergency medical care. Website communications are not continuously monitored and do not provide emergency response or urgent triage.

4. No Provider-Patient Relationship From Website Use

Reading content, downloading a form, sending email, submitting a general contact form, or requesting an appointment does not by itself create a provider-patient relationship. An appointment request is subject to acceptance and confirmation. A clinical relationship arises only through an appropriate process accepted by Health Builders PC and the responsible healthcare professional.

5. Permitted Use

Subject to these Terms, Health Builders PC grants you a limited, revocable, nonexclusive, nontransferable permission to access and view the website for your personal, lawful, noncommercial use. You may print or save a reasonable number of pages for your own healthcare education, appointment preparation, or personal records, provided that you retain all copyright, trademark, authorship, source, and other proprietary notices.

This permission does not transfer ownership and does not authorize publication, distribution, commercial exploitation, systematic collection, or creation of a competing resource.

6. Prohibited Use

You may not use the website to:

violate law, regulation, professional duty, contract, or another person’s rights;

impersonate a person or misrepresent identity, authority, affiliation, endorsement, or source;

submit false, fraudulent, abusive, threatening, defamatory, infringing, discriminatory, or unlawful material;

attempt to obtain medical care, prescriptions, controlled substances, billing treatment, or benefits through deception;

interfere with website operation, security, availability, accounts, servers, networks, or other users;

introduce malware, malicious code, automated attacks, denial-of-service traffic, or deceptive redirects;

probe, scan, test, bypass, defeat, or circumvent access controls, authentication, rate limits, robots instructions, security measures, or technological protections;

access a nonpublic area or account without authorization;

collect personal information about patients, visitors, staff, or providers;

use contact information for spam, harassment, solicitation, data brokerage, or unrelated marketing;

frame, mirror, reproduce, republish, syndicate, or distribute the website or a material part of it without written permission;

remove, obscure, alter, or falsify a copyright, trademark, attribution, watermark, metadata field, access-control notice, or proprietary notice;

use website content to create or improve a competing commercial website, directory, database, healthcare marketing product, or content library;

falsely present Health Builders PC content as your own or as the work of another person;

create a derivative work from protected website material except as allowed by law or written permission; or

assist another person in any prohibited activity.

7. Automated Access, Scraping, and Model Training

Except for ordinary search-engine indexing that respects published access controls, robots instructions, rate limits, and applicable law, you may not use a robot, crawler, scraper, spider, data-mining process, browser automation, agent, script, API, bulk downloader, or similar method to access or extract website material without prior written permission from Health Builders PC or the applicable rights holder.

Prohibited automated activity includes:

systematic copying of articles, treatment explanations, condition content, frequently asked questions, testimonials, pricing, provider information, graphics, photographs, infographics, metadata, or structured data;

bulk downloading or repeated extraction beyond ordinary personal browsing;

building or enriching a database, content repository, search product, answer engine, commercial dataset, or competing website;

using website material for training, fine-tuning, retrieval augmentation, evaluation, grounding, or other ingestion by an artificial-intelligence or machine-learning system when the use requires authorization;

evading technical controls or rotating identifiers to avoid rate limits; and

using automated access in a manner that burdens the website or impairs access for others.

These restrictions operate as contractual conditions and preserve all rights available under copyright, trademark, unfair competition, computer-access, technological-protection, trespass, contract, and other applicable law. They do not claim that every automated access violation independently creates liability under every statute. Health Builders PC may use technical controls, rate limits, access restrictions, robots directives, monitoring, and legal remedies to protect the website.

A search engine may crawl publicly available pages for ordinary indexing when it complies with applicable access controls and does not use the content for an independently prohibited purpose.

8. Intellectual Property

The website contains material owned by or licensed to Health Builders PC, its licensors, the website developer, photographers, designers, authors, contractors, manufacturers, or other applicable rights holders.

Protected material can include:

website copy and patient education;

articles, research summaries, treatment explanations, forms, and downloadable materials;

photographs, illustrations, diagrams, icons, videos, and infographics;

original graphics, visual compositions, selection, arrangement, editing, modification, and compilation;

page design, layout, interface elements, and code to the extent protected by law;

databases and collections to the extent protected by law;

provider materials, biographies, and original educational content;

logos, trade names, service names, slogans, and distinctive branding; and

human-authored or otherwise legally protectable elements of AI-assisted material.

Copyright protection for AI-assisted material depends on human authorship. Health Builders PC and applicable rights holders claim protection only for elements protected by law, including human-authored text, selection, arrangement, editing, modification, compositing, design direction, and other original expression. These Terms do not assert copyright in purely machine-generated material when copyright law does not provide it.

Unless a separate written agreement states otherwise, nothing on the website transfers a copyright, license, patent right, trade-secret right, publicity right, or other proprietary interest to you.

9. Trademarks, Service Marks, Trade Names, and Branding

Health Builders, Health Builders PC, associated logos, service names, branding, and other source-identifying materials are trademarks, service marks, trade names, or other protected identifiers of Health Builders PC and/or their applicable owners.

Rights can arise through federal registration, Virginia registration, common-law use, service-mark use, trade-name law, unfair-competition law, false-designation-of-origin law, passing-off law, and other applicable law. The absence of a federal registration does not establish the absence of trademark rights.

Nothing on the website grants a right to use a mark without prior written authorization. You may not use a mark in a way likely to cause confusion, imply endorsement, imply affiliation, misrepresent source, pass off another service as connected with Health Builders PC, dilute a distinctive mark, or exploit Health Builders PC goodwill.

Do not use the registered trademark symbol with a Health Builders mark unless an active federal registration for the specific mark and applicable goods or services has been verified. Health Builders PC may use TM or SM to identify claimed trademark or service-mark rights without representing federal registration.

Third-party names and marks remain the property of their respective owners. Reference to a third party does not grant any trademark right or establish endorsement.

10. Copyright Complaints

A rights holder who believes website content infringes a copyright may contact Health Builders PC at info@nvhb.org and provide:

identification of the copyrighted work;

identification and location of the allegedly infringing material;

contact information;

a statement of good-faith belief that the use is unauthorized;

a statement that the information is accurate and, under penalty of perjury, that the sender is authorized to act; and

a physical or electronic signature.

This contact process does not designate an agent under 17 U.S.C. 512 unless Health Builders PC separately completes the required Copyright Office designation.

11. User Submissions

You remain responsible for information you submit through the website. You represent that you have the authority to submit it and that your submission does not violate law or another person’s rights.

Do not submit material for public display, publication, testimonial use, or marketing unless Health Builders PC expressly requests it and provides an appropriate authorization process. A public review posted to an independent platform does not automatically grant Health Builders PC every right needed to republish protected health information, a name, a likeness, or copyrighted material.

For information submitted privately through a contact or appointment form, you grant Health Builders PC the limited authority needed to receive, store, transmit, review, and respond to the request and to perform related legal, security, and administrative functions. This limited authority does not authorize public marketing use.

12. Forms and Electronic Communications

Website forms are for contact and appointment requests. Do not submit emergencies, Social Security numbers, payment-card information, complete medical records, or highly sensitive medical details through a general form.

By submitting contact information and requesting a response, you authorize Health Builders PC to contact you through the method you selected or another reasonable method related to your request. This authorization does not create consent for automated marketing calls, marketing text messages, or unrelated commercial email unless a separate legally sufficient consent applies.

Email and text messages can create privacy risks, including misdelivery, device access, carrier records, and unencrypted transmission. Health Builders PC may ask you to use another communication method when appropriate.

You may revoke permission for future nonessential text messages by using the stated opt-out method or contacting Health Builders PC. Revocation does not affect communications already sent or communications otherwise permitted by law.

13. Appointment Requests and Scheduling

Submitting a request does not guarantee an appointment, provider, date, time, service, price, or response period. Health Builders PC may decline, redirect, or reschedule a request based on clinical appropriateness, provider availability, safety, service availability, payment requirements, or another lawful reason.

Health Builders PC requires at least 24 hours’ notice for cancellation or rescheduling. The currently published missed-appointment fee is $50 for chiropractic appointments and $100 for medical appointments. The applicable scheduling terms should be confirmed when the appointment is made.

14. Treatment, Pricing, Insurance, and Medicare Information

Website descriptions do not establish personal candidacy, medical necessity, expected results, insurance coverage, Medicare treatment, reimbursement, or the final charge.

Health Builders PC is out of network with commercial insurance for its integrative medical care. Payment is due at the time of service. For eligible non-Medicare services, Health Builders PC can provide a superbill for submission to an insurance plan. A superbill does not guarantee reimbursement.

Dr. Hai Jin Kim has opted out of Medicare and sees Medicare patients under a private contract. Andrea Kubota, FNP-BC, is out of network with Medicare. Dr. Brett Fuller is in network with Medicare only. Provider status, service coverage, private-contract requirements, and patient responsibility should be confirmed before care.

Eligible uninsured and self-pay patients have Good Faith Estimate rights. Those rights are described on the Good Faith Estimates and Billing Rights page and are not limited by these Terms.

15. Testimonials and Reviews

Testimonials and review excerpts describe individual experiences. Experiences and outcomes vary. No testimonial guarantees a result or establishes that a treatment is appropriate for you.

Excerpts may originate on independent platforms such as Google and may be shortened for length without materially changing meaning. Health Builders PC is responsible for obtaining permissions and substantiation required for its own republication. A disclaimer cannot cure a false, misleading, unsubstantiated, or improperly authorized advertising claim.

16. AI-Assisted and Illustrative Visuals

Some visual content was created, modified, or enhanced using artificial intelligence or other digital tools. It may depict fictional patients, illustrative clinical encounters, treatments, or authorized likenesses of Health Builders team members.

Unless expressly identified as documentary photography of an actual event, an illustrative visual should not be interpreted as proof that the depicted encounter occurred, that a depicted person received care, or that a treatment produced a depicted result.

Health Builders PC must obtain appropriate permission for the use of staff likenesses, patient likenesses, and other protected material. These Terms do not grant a visitor a right to copy or reuse those likenesses.

17. Third-Party Links and Services

The website may link to or embed maps, videos, research, review platforms, manufacturer information, social media, government resources, and other third-party content. Health Builders PC does not control third-party availability, content, security, accessibility, privacy, or terms.

A link or reference does not establish endorsement of every statement, product, service, or practice of the third party. Your use of a third-party service is governed by the third party’s terms and privacy practices.

18. Accuracy, Updates, and Availability

Health Builders PC may revise website content and correct errors without notice. Medical knowledge, laws, prices, provider schedules, services, insurance information, forms, and technologies change. Health Builders PC does not guarantee that every page is current, complete, error-free, continuously available, or suitable for a particular purpose.

Health Builders PC may suspend, restrict, modify, or discontinue a website feature. Maintenance, outages, attacks, vendor failures, or events outside reasonable control can affect availability.

19. Disclaimer of Website Warranties

To the maximum extent permitted by law, the website is provided on an “as available” basis for general information. Health Builders PC and applicable licensors disclaim warranties concerning website operation, uninterrupted access, error-free content, merchantability, fitness for a particular nonclinical purpose, noninfringement, and the absence of harmful code, except to the extent a warranty cannot lawfully be disclaimed.

This section concerns the public website. It does not disclaim or reduce a healthcare professional’s duties concerning actual clinical care.

20. Limitation of Liability for Website Use

To the maximum extent permitted by law, Health Builders PC, its directors, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from public website access, website unavailability, reliance on general website information, or unauthorized website misuse, even if advised that such damages were possible.

For a claim arising solely from website use and unrelated to actual clinical care, the aggregate liability of Health Builders PC will not exceed the greater of $100 or the amount, if any, you paid directly to Health Builders PC for the specific website feature giving rise to the claim during the preceding twelve months, except where applicable law prohibits the limitation.

These limitations do not apply to actual healthcare, professional negligence, medical malpractice, personal injury caused by clinical care, fraud, willful misconduct, a right that cannot lawfully be limited, or a remedy expressly preserved by law. These Terms do not require a patient to release a claim for future clinical negligence.

21. Responsibility for Unlawful Misuse

To the extent permitted by law, you are responsible for losses, claims, and reasonable costs arising from your unlawful use of the website, your infringement of another person’s intellectual-property or privacy rights, or your material violation of these Terms. This provision does not require a patient to indemnify Health Builders PC for Health Builders PC’s clinical negligence, malpractice, willful misconduct, or violation of law.

22. Restriction or Termination of Access

Health Builders PC may restrict or terminate website access when it reasonably believes a person has violated these Terms, threatened security, infringed rights, abused a form, burdened the website, or created a legal or operational risk. Restriction does not alter rights concerning medical records, continuity of care, emergency care, nondiscrimination, or termination of a clinical relationship, which are governed separately.

23. Governing Law and Venue

Virginia law governs these Terms and website-use disputes, without regard to conflict-of-law rules, except where federal law controls.

A lawsuit arising solely from website use must be brought in a court of competent jurisdiction in Fairfax County, Virginia, unless applicable law requires another forum. This website venue provision does not govern a dispute arising from actual clinical care when another law, agreement, venue rule, or professional-liability requirement applies.

These Terms do not impose mandatory arbitration, a class-action waiver, a jury-trial waiver, or a waiver of rights involving actual clinical negligence.

24. Changes to These Terms

Health Builders PC may update these Terms by posting a revised version and changing the “Last updated” date. A material change will be communicated in an additional manner when required. Continued use after the effective date of revised Terms constitutes acceptance to the extent permitted by law.

25. Severability, Waiver, and Assignment

If a provision is held unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue. Provisions concerning intellectual property, prohibited use, disclaimers, limitations, responsibility for unlawful misuse, governing law, and other provisions that logically continue will survive termination of website access. Failure to enforce a provision is not a waiver. You may not assign rights under these Terms without written permission. Health Builders PC may assign these Terms in connection with a lawful reorganization, transfer, or business transaction, subject to applicable privacy and healthcare law.

26. Entire Website Agreement

These Terms, the Website Privacy Policy, Medical Disclaimer, and any feature-specific terms constitute the agreement concerning public website use. Clinical consent forms, financial policies, privacy notices, private contracts, Good Faith Estimates, and other patient agreements remain separate and control the subjects they address.
